Acceptance of Terms
Your use of the magazine shall be subject to complying at all times with the acceptance of terms.
For the purposes of these user terms:
LR Publishing ltd© are either the owner or the licensee of the intellectual property rights in the Tattooist Art Magazine™ and the material published in it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
The reading of this magazine and any external literature referencing the content in the magazine are subject to the following terms and conditions.
Content
The copyright material contained in Tattooist Art Magazine™ which includes literature, photographs and graphics is owned by LR Publishing ltd©. You do not have any right or say in what material is printed in Tattooist Art Magazine™ unless otherwise externally indicated. All rights are reserved.
The trademarks, service marks, and logos contained in Tattooist Art Magazine™ are registered and owned only by LR Publishing ltd©. You do not have any right to use, copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit or disseminate the Trade Marks without the prior written consent of LR Publishing ltd©
You are permitted to read the content and use any of the content published in this magazine for personal use only, noted that the material is copyrighted. Commercial or public use of any of the content or material is prohibited.
Content submitted to Tattooist Art Magazine™
Any content, information, data, text, photographs, graphics, video or sound clips, messages or other materials that may be posted, emailed or used publicly or privately, for use in the magazine, is only done so in the knowledge that information submitted has full copyright by the supplier, and/or that they have been granted permission for the use of the appropriate content. LR Publishing ltd© does not take responsibility for any content that is misused, and all copyright responsibility should be should be taken up with the originator.
Links to third Parties
Tattooist Art Magazine™ magazine links to many third party information providers who are not affiliated with Tattooist Art Magazine™.
Tattooist Art Magazine™ does not endorse any of this content, nor the information or merchandise contained or offered by these providers. Tattooist Art Magazine™ has not taken any steps to confirm the accuracy or reliability of any of the information contained in such third parties' content, and does not make any representations or warranties as to the security of any information (including, without limitation, personal information) you might be requested to give any third party.
You are strongly encouraged to make whatever investigation you feel necessary or appropriate before proceeding with any transaction with any of these third parties.
All aspects of this content including, without limitation, text, and graphics, and links, are provided on an "as is" basis with no warranties of any kind.
In no event shall the magazine be liable for any damages whatsoever, including, without limitation, ,lost profits, lost data, or any direct, indirect, special, punitive, incidental, exemplary or consequential damages related to the use, inability to use, performance or non-performance of the information or merchandise offered by such third party sites, even if Tattooist Art Magazine™ has been advised previously of the possibility of such losses or damages.
Member code of conduct
We strive to provide an enjoyable reading experience for our users, so we may monitor content in the magazine, including photographs and text in keeping with this Agreement. All readers of the magazine hereby specifically agree to such monitoring. Nevertheless, we do not make any warranties or guarantees that: (1) the magazine, or any portion thereof, will be monitored for accuracy or unacceptable use, (2) apparent statements of fact will be authenticated, or (3) we will take any specific action (or any action at all) in the event of a dispute regarding compliance or non-compliance with this Agreement.
A. The magazine is not intended for children, and the publisher does not knowingly collect personally identifiable information from such users. Such users are expressly prohibited from submitting their personally identifiable information to us, and from using portions of the magazine for which registration is required, such as the magazine registration or any external content which requires entering such information. Any information submitted by such users will not knowingly be used, posted, or retained by us.
B. Unless otherwise specified, the magazine is intended for your personal use only you are responsible for all use of the magazine by you and by those you allow to use, or provide access to, the magazine.
C. You agree not to use any obscene, indecent, or offensive language or to provide to or post on or through any external links or content, any graphics, text, photographs, images, video, audio or other material that is defamatory, abusive, bullying, harassing, racist, hateful, or violent. You agree to refrain from ethnic slurs, religious intolerance, homophobia, and personal attacks when using these external links.
E. You further agree not to use any sexually explicit language or to provide to or post on or through external links referencing the magazine, any graphics, text, photographs, images, video, audio or other material that is sexually explicit. Do not “cyber” or solicit another to “cyber” (participate in virtual sex) on or through these external links.
F. You may not provide to or post on or through external links any graphics, text, photographs, images, video, audio or other material that is encrypted, invades anyone's privacy, or illustrates, references or encourages conduct that would constitute a criminal offence, give rise to civil liability, or that otherwise violates any local, state, federal, national or international law or regulation (e.g., drug use, underage drinking). You agree to use the magazine only for lawful purposes and you acknowledge that your failure to do so may subject you to civil and criminal liability. Do not provide to or post on or through external links any graphics, text, photographs, images, video, audio or other material that includes instructions for weapon and/or explosive manufacture or use.
G. You are responsible for ensuring that any graphics, text, photographs, images, video, audio or other material you provide to or post on external links, including without limitation in bulletin boards, forums, personal ads, chats or elsewhere, does not violate the copyright, trademark, trade secret or any other personal or proprietary rights of any third party or is provided or posted with the permission of the owner(s) of such rights.
H. The magazine may contain graphics, text, photographs, images, and other material that is clearly identified for your use (“Assets”). The Assets are protected by national and international copyright, trademark and other intellectual property laws. Nevertheless, we (LR Publishing ltd©) grant to you the limited, non-exclusive, right and license to use the Assets solely as described in the magazine, as limited by this Agreement, and provided further that you keep intact any and all copyright and other proprietary notices.
I. The magazine also contains other graphics, text, photographs, images, video, audio, software, code, and other material that is provided by LR Publishing ltd© or its licensors and is not clearly identified as, or intended, for your use, including without limitation the organization, design, compilation, and “look and feel content” of the magazine, and advertising thereon (“Magazine Content”). The Magazine Content is protected by national and international copyright, trademark and other intellectual property laws, and is the property of Service Provider or its licensors. The copying, reproduction, publication, display, rearrangement, redistribution, modification, revision, alteration, cropping, re-sizing, reverse engineering, movement, removal, deletion, or other use or change by you, directly or indirectly, of any such magazine content, including but not limited to the removal or alteration of advertising, is strictly prohibited.
J. You may not in any way make commercial or other unauthorized use, by publication, re-transmission, distribution, performance, caching, or otherwise, of material obtained through the magazine, including without limitation the Assets or magazine content, except as permitted by the Copyright Act or other law or as expressly permitted in writing by this Agreement or LR Publishing ltd©.
K. You agree not to disrupt, overwhelm, attack, modify, reverse engineer or interfere with the magazine or its associated publishers, in any way, and you agree not to impede or interfere with others' use of the magazine.
Privacy Policy
If you provide information to Tattooist Art Magazine™ by registering through any of its external links or it’s own content, Tattooist Art Magazine™ will use it in accordance with the terms of its privacy policy. That privacy policy forms part of these Terms and Conditions and by reading this magazine you acknowledge and agree that you have read and accept the terms of that privacy policy.
Disclaimer Agreement
1. All the contents of Tattooist Art Magazine™ are only for general information and/or use. Such contents do not constitute advice and should not be relied upon in making (or refraining from making) any decision. Any specific advice or replies to queries in any part of the magazine is/are the personal opinion of such experts/consultants/persons and are not subscribed to by Tattooist Art Magazine™
2. The information in Tattooist Art Magazine™ is provided on an "AS IS" basis, and all warranties, expressed or implied of any kind, regarding any matter pertaining to any information, advice or replies are disclaimed and excluded.
3. Tattooist Art Magazine™ and its associates shall not be liable, at any time for damages (including, without limitation, damages for loss of any kind) arising in contract, tort or otherwise from the use of or inability to use the magazine, or any of its contents, or from any action taken (or refrained from being taken) as a result of using the magazine or any such contents. This magazine is written about professionals, who are legally qualified to practice tattooing, and therefore it is not responsible for the external use of tattoos.
4. No representations, warranties, or guarantees whatsoever are made as to the accuracy, adequacy, reliability, completeness, suitability, or applicability of the information to a particular situation.
5. Certain links in the magazine lead to resources located on servers maintained by third parties over whom Tattooist Art Magazine™ has no control or connection, business or otherwise. These sites are external to Tattooist Art Magazine™ and by visiting these; you are doing so of your own accord and assume all responsibility for such action.
Material Submitted by Users
Some sections in the magazine contain materials submitted by users. Tattooist Art Magazine™ accepts no responsibility for the content, accuracy, and conformity to applicable laws of such material.
Entire Agreement
These terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
Access Restriction
Tattooist Art Magazine™ holds the right to withdraw any membership you sign up to for the magazine or through external links e.g. websites referencing Tattooist Art Magazine™, should you fail to comply with the terms and conditions and the privacy policy.
Refund of Membership Fee
Should you wish to cancel your membership to the magazine, all enquiries will be eligible for cancellation as long as the request is received within 48 hours of the time the order is placed. After that, in most cases, cancellations will not be accepted
If you order Items out of stock or sold out/discontinued directly linked to the Tattooist Art Magazine™, we will notify you as soon as possible and, if requested, any sum debited by us from your credit/debit card will be re-credited to your account. The refund will be made as soon as possible and in any event within 30 days of your order. LR Publishing ltd© will not be obliged to offer any additional compensation for disappointment suffered. Under no circumstances will LR Publishing ltd© liability extend to more than a full refund. This does not affect your statutory rights. If the goods ordered are received faulty, please contact our administration department within 7 days of the order being received, where we will provide you with an address of where to return the items once these have been received, a replacement will be sent out immediately or a refund given.
If for any reason you are unhappy with the Tattooist Art Magazine™ merchandise you have purchased from us, please contact us within 7 days of receiving the item(s) where we will provide you with a return address. *Once these items have been received a refund will be made*. NB. Any items that are returned will only be refunded if they are returned in their original packaging and are unused/ unworn. Postage and Packaging costs will not be refunded.
Magazine Competitions
If you take part in any competition which is printed in Tattooist Art Magazine™ you agree to be bound by the Competition Rules and any other rules specified by Tattooist Art Magazine™ from time to time, and by the decisions of Tattooist Art Magazine™ and its publishers, which are final in all matters relating to the Competition. Tattooist Art Magazine™ reserves the right to disqualify any entrant and/or winner in its absolute discretion without notice in accordance with the competition Rules.
General
Nothing in these Terms & Conditions of Use shall restrict or exclude any liability that we have to any party which cannot be excluded by law. These Terms & Conditions of Use shall be governed by law and the courts of England and Wales shall have exclusive jurisdiction. If any provision(s) of these Terms and Conditions is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties and all other provisions shall remain in full force and effect.
